Insurance companies have to order a responsible person registrar since the Deregulierung of insurance. Its major task is it to ensure the computation of appropriate covering resetting. It confirms the correct determination of the covering resetting under the balance.

General information

The institution of the responsible person of registrar is embodied in the law of supervision of insurance (VAG). A responsible person registrar to order must

• Life insurance enterprise (including the pension and burial funds)
• Accident insurance enterprises, which operate the accident insurance with restitution of the premiums
• Damage/accident insurance enterprise with pension achievements from accident or liability insurance
• Health insurance enterprises, which operate the substitutive health insurance.

The responsible person registrar must be reliable as well as have sufficient knowledge in the actuarial science and professional experience.

The responsible person registrar is to be ordered with agreement of the supervisory board or dismissed. The supervisory authority can require that another responsible person registrar is designated and/or ordered.

Tasks

The responsible person registrar has to guarantee that with the computation of the contributions and the covering resetting the relevant legal regulations are kept. Those does not apply to burial funds and pension funds, for which an statement was not met after "§156a exp. 3 sentence 5 VAG ("adjusted pension funds"), since in these the calculation is finally given by the authorized business plan.

It has to confirm under the balance that the covering resetting is formed in accordance with the relevant legal regulations (statistical confirmation). (Exception: smaller association after "§ 53 VAG). With burial funds and adjusted pension funds it is to be confirmed that the covering resetting corresponds to the authorized business plan.

The responsible person registrar has to describe in a report to the executive committee ("registrar report"), which calculation beginnings and acceptance of this confirmation to be the basis. This applies not to health insurances and adjusted pension and burial fund with these enterprises exists can the responsible person registrar the bases of calculation not "freely" determine: In the health insurance the insurance company needs the permission of an independent trustee. The calculation of the adjusted pension and burial funds is fixed by the business plan.

If the responsible person registrar states that he the confirmation not or only reduced, then has he can deliver the executive committee and if necessary also the supervisory authority inform. This applies also to facts, which can impair or endanger the development or the existence of the enterprise substantially.

The responsible person registrar has to make suggestions for an appropriate surplus participation of the surplus-entitled contracts for the executive committee. This does not apply to the health insurance.
