Incident one generally calls the unscheduled enterprise of a technical plant, in particular the chemical industry, or a nuclear power station.
In the legal sense the term of the incident for different technical plants and/or enterprises is differently defined.
In the nuclear technology an incident is not an event and/or an event, when its occurring the enterprise of the plant or the activity for safety-relevant reasons to be continued can or may and for that the plant is appropriate or for with the activity the measures and mechanisms is as a precaution intended. An incident entails always a reactor reactor trip scram. (see "§ 3 exp. 1 No. 28 radiation protection regulation).
On that internationally Nuclear Event Scale (INES scale) corresponds an incident to the stage 2, a serious incident of the stage 3.
In the chemical industry as well as other enterprises, in addition, to public bodies (with exception of mechanisms of the national defense), the regulations of the 12 apply for the commercial economy in Germany. Regulation to the federal immission control law - incident regulation from 8 June 2005 (BGBl. I No. 33 from 16 June 2005 P. 1598). Here the substantial requirements are defined among other things to the operators of instrument ranges and/or plants, which fall under the range of application of the incident regulation, (obligations exist for the production of security concept, safety management, safety report, operational alarm and danger warning plans as well as for the information of the public). In accordance with this regulation an incident is defined as "an event, like e.g. an emission, a fire or an explosion of larger extent, which results from a disturbance of the intended enterprise in an instrument range falling under this regulation or in a plant falling under this regulation, which directly or later introduces within or outside of the instrument range or the plant to a serious danger or to damages to property after appendix VI part 1 number I No. 4 of the incident regulation and with or several dangerous materials are involved ".
The dangerous materials are thereby in the regulation mentioned. Instrument ranges and/or plants, for which the regulation is used, are such for which quantity threshold of existing dangerous materials intended, limit values defined in which regulation exceed.
